President Stevandić: The Law on the Immunity of the Republic of Srpska protects its legislative process

The President of the National Assembly of the Republic of Srpska, Dr Nenad Stevandić, said today at a Public discussion on the Draft Law on Immunity of the Republic of Srpska that this Law is the reaction to the decisions of the Constitutional Court of BiH and OHR, and that by enacting this Law we protect the legislative process.

“By this Draft Law MPs who have creditworthiness for bringing laws, decisions, and acts should stay protected. This Law does not provide protection from illegal actions, but it provides regular work of the Republic of Srpska institutions” said Stevandić at the Public Discussion.  

Stevandić made clear that this Draft Law protects also those who carry out the acts of the National Assembly, the President of the Republic of Srpska who sends them by decree to the Official Gazette, or the director of the Geodetic administration when it is about property issues and the director of the Official Gazette who can not be incriminated for the issues this act regulates.

When we talk about eventual possible abuses, Stevandić said that they are based on presumptions, stressing that enacting this law represents concrete and real benefits.

Stevandić noticed that this law represents the question of subjectivity and sovereignty of the Republic of Srpska.

It is much better to have a law regulating these issues than a vacuum. Without enacting this law, it would be as the Republic of Srpska is not capable of defending itself from attacks on its institutions” Stevandić considers.

He stressed that no minister nor other person carrying out the decisions of the parliament of the Republic of Srpska is not being been protected by this law for traffic incidents, public tender malversations, robbery, corruption, and all other issues regulated by the Crime Act or any other laws.

“This law is not being enacted for anyone to have the right to any kind of misuse, because this is being regulated by other legislative acts”, stressed Stevandić.  

A Public Discussion on the Draft Law on Immunity and the Draft Law on Referendum and Citizens the proposal of the MPs, in the organization of the Ministry of Justice and the Ministry of Administration and Local self-government of the Republic of Srpska, has been held today in the National Assembly of the Republic of Srpska.
