The National Assembly of the Republic of Srpska will announce the Republican Commission report on the ascertainment of the Referendum results, in accordance with Article 70 of the Constitution of the Republic of Srpska and in accordance with paragraph 5 of the Decision on the ascertainment of the results of the Republic referendum, as it always did, after the procedure, defined by the Constitutional Court, which implies that the Council for protection of vital interest, acting in Constitutional Court, brings the final decision in this subject.
As we know, Club of the Bosnian people in the Council of Peoples initiated the procedure of violation of vital national interest in the decision on results of the Republican Referendum.
After the Joint Commission of the National Assembly and the Council of Peoples at its Session held on November 16 did not reach a consensus about violation of vital national interests of the Bosnian people, the decision on the results of the Republican Referendum was sent to the Constitutional Court of the Republic of Srpska and the Council for the protection of vital interest.
In accordance with the aforementioned constitutional procedure, the Committee on Constitutional Affairs of the National Assembly of the Republic of Srpska yesterday, November 30, determined the answer of the National Assembly to the Court.
The final decision of the Constitutional Court of the Republic of Srpska is expected within 30 days and only after that decision, the conditions will be met for the results to be published in the "Official Gazette of the Republic of Srpska", if the court does not deny it.
We emphasize once again that this is a normal constitutional procedure when it comes to the acts of the National Assembly, which imply the procedure on violation of vital national interest. In these cases, the law-making or any other disputed act goes to the harmonization of the Joint Commission of the National Assembly and the Council of Peoples and if no agreement is reached, the Commission passes the act to the Constitutional Court, which decides on the admissibility and merits.
Only after decisions of the Constitutional Court of the Republic of Srpska are published, acts which the court does not deny, are published in the "Official Gazette of the Republic of Srpska".
Information that emerged today in the media are not accurate and least are based on ignorance of the Constitution of the Republic of Srpska and legislative procedures of passing the acts.
